Finance House Securities Smart Device Privacy Policy

This Finance House Securities LLC (FHS) Smart Device Privacy Policy (“Privacy Policy”) governs user’s use of FHS Electronic Trading Application (“Application”) when installed and activated on the user’s electronic smart devices such as smart mobile phones, tablets and other handheld devices. The Application is a transactional application where users can buy and sell financial securities made available to them for trading.

USER’S INFORMATION

Registration for the Application is optional. In the event of non-registration, user may not be able to use the features offered by the Application. Alternatively, if user chooses to register, user would be able to use the features offered by the Application. Additionally, during such registration and usage of the Application, user would generally be required to provide the following information:
(a) user name, password and other registration information;
(b) transaction-related information;
(c) information which user provides to us upon contacting us for help or assistance.

AUTOMATICALLY COLLECTED INFORMATION

The Application will collect certain information automatically, including, but not limited to, the type of mobile device, unique ID and IP address of such mobile device(s), mobile device’s operating system, the type of mobile Internet browsers, and information about the way user uses the Application.
‘User’s Information’ and ‘Automatically Collected Information’ are hereinafter, collectively referred to as the “Information”.

AUTHORIZATION TO INFORMATION

FHS may use the Information to contact user from time to time and provide the important information, required notifications and marketing promotions to user.

GEOGRAPHIC LOCATION DATA

The Application does not use or collect user precise geographic location.

INFORMATION SHARING WITH THIRD PARTIES

We may share the Information with third parties only in the ways that are described under this Privacy Policy and may disclose the Information:
(i) as required by law, such as to comply with a subpoena, or similar legal process; and/or
(ii) when we believe in good faith that disclosure is necessary to protect our rights, protect user’s safety or the safety of others, investigate fraud, or respond to a Government/Regulator request.

DATA RETENTION POLICY

We will retain the Information data up to the retention period stated in the regulations stipulated by the Securities and Commodities Authority of the UAE.
Irrespective of the above, FHS may still retain the data to the extent such retention is necessary to resolve disputes, enforce signed user agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of services.

SECURITY

We are concerned about safeguarding the confidentiality of the Information and we follow generally accepted industry standards to protect information we process and maintain. Information data is stored behind a firewall in secure operating environment inaccessible by general public and only by authorized personnel. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

FHS’S NO LIABILITY

USER ACKNOWLEDGES AND AGREES THAT NEITHER FHS, NOR ANY DIRECTOR, OFFICER, EMPLOYEE, AGENT AND THE LIKE SHALL BE LIABLE TO USER FOR ANY DEVICE THEFT, DAMAGE, ABUSE, AND UNAUTHORIZED USE OF THE APPLICATION, OR FOR ANY DAMAGE TO ANY SMART DEVICE WHILE DOWNLOADING OR ACCESSING THE APPLICATION, FOR ANY REASON WHATSOEVER, INCLUDING WITHOUT LIMITATION CLAIMS BASED ON CONTRACT, TORT AND/OR ANY OTHER LEGAL REMEDY.

FHS shall not be liable or responsible in any manner whatsoever for:

(i) any breach or leakage of personal information of the user saved or contained in the Application whether attributed to a virus, malfunctioning of the Application or smart device or otherwise;
(ii) damages, losses, impairment or limitation of functionality, of any kind or type that impacts or may impact user’s smart device and the Application thereon;
(iii) for any virus or other related problems that may be attributable to the smart device services or to any services provided by any smart device service provider;
(iv) providing technical assistance or supporting any smart devices and/or personal software on smart devices.

USER INDEMNIFICATION

The user agrees to defend, indemnify and hold FHS, their other officers, directors, employees or agents (each an “Indemnified Party”), harmless from and against any and all losses, liabilities, damages, costs and expenses (including, without limitation, litigation costs, legal and other professional fees and expenses) awarded against, or incurred or paid, directly or indirectly, by or sought to be imposed upon an Indemnified Party as a result of or in connection with any and all claims, demands, actions, or proceedings of whatsoever nature made or brought against an Indemnified Party by any third party and arising out of or relating to the user’s use or misuse of the Application or any loss or mishandling of data or information resulting from my usage of the Application or any breach to the terms of this Privacy Policy and/or other applicable FHS’s policies and procedures.

DISPUTES

This Privacy Policy shall be governed by and construed in accordance with the laws of the Emirate of Abu Dhabi and the United Arab Emirates applicable therein and the user, irrevocably submit to the exclusive jurisdiction of the courts of the Emirate of Abu Dhabi provided that such submission shall not prejudice FHS’s rights to bring proceedings in any other court of competent jurisdiction or, to the extent allowed by law, concurrently in more than one jurisdiction.

CHANGES

This Privacy Policy may be updated or amended from time to time for any reason. Users are advised to consult this Privacy Policy regularly for any changes or amendments, as continued use is deemed approval of all updates or amendments.

GENERAL PROVISIONS

This Privacy Policy constitutes an integral part of and complementary to the Electronic Trading Account Opening Form executed by the user.
All the provisions of this Privacy Policy are to be construed as covenants and agreements. If any provision of this Privacy Policy is determined to be illegal or unenforceable, it shall be considered separate and severable from the remaining provisions of this Privacy Policy, which shall remain in force and be binding as though this provision had never been included.

INCIDENT REPORTING

USER CONSENT

I acknowledge that I have fully read, understand and agree to comply by this Privacy Policy, understand the appropriate uses of the Application and consent to the use and processing of the Information as set forth in this Privacy Policy. I also acknowledge and agree to comply with any updates or amendments to the Application.
